Términos del Servicio
Estos Términos del Servicio ("Términos") rigen tu acceso y uso de los sitios web, las aplicaciones móviles, la API y los servicios relacionados (en conjunto, los "Servicios") de Bariatric AI ("Bariatric AI", "nosotros" o "nuestro"). Al acceder a los Servicios o usarlos, aceptás estos Términos.
Importante. Los Servicios no brindan asesoramiento médico y no reemplazan el criterio de un profesional de la salud. Mirá nuestro Aviso médico y la sección 6.
1. Requisitos para usar los Servicios
Para usar los Servicios tenés que tener al menos 18 años y capacidad legal para celebrar un contrato. Al usar los Servicios, declarás que cumplís con estos requisitos.
2. Cuentas
2.1 Creación de la cuenta
Te comprometés a dar información exacta y a mantenerla actualizada. Sos responsable de la actividad de tu cuenta y de cuidar tus credenciales.
2.2 Cuentas de clínicas (B2B)
Cuando una clínica u organización de salud ("Clínica Cliente") te da acceso a los Servicios, la Clínica Cliente es responsable de tu uso de los Servicios, y también se aplican los Términos y Condiciones B2B de Bariatric AI para Clínicas y el Acuerdo de Tratamiento de Datos que la Clínica Cliente acepta al suscribirse. Bariatric AI hoy no firma acuerdos de business associate (BAA) de HIPAA; mirá nuestra página de HIPAA.
3. Planes de suscripción y pagos
- Los planes, precios y condiciones de Bariatric AI para Clínicas están en bariatricai.io/clinicas y se rigen por los Términos y Condiciones B2B de Bariatric AI para Clínicas, que la clínica acepta al suscribirse.
- Planes B2C: una prueba de 7 días con uso limitado de las funciones de IA (sin tarjeta de crédito), después de la cual la cuenta conserva solo un pequeño uso gratuito; Pro (USD 7,99 por mes, o USD 86,29 por año con facturación anual) y Max (USD 11,99 por mes, o USD 129,49 por año con facturación anual), con facturación mensual o anual salvo que se indique otra cosa. Pro y Max incluyen un cupo mensual de mensajes de IA y de análisis de fotos de comidas, según se muestra en la app y en nuestra página de precios.
- Los cargos no son reembolsables, salvo cuando la ley lo exija.
- Derecho de revocación (consumidores en Argentina): si contrataste como consumidor por internet o desde la app, podés revocar la contratación dentro de los 10 días corridos desde que la hiciste, sin costo y sin dar explicaciones, escribiendo a legal@bariatricai.io (artículo 34 de la Ley 24.240). Si la compra la hiciste en App Store o Google Play, el reintegro lo procesa esa tienda; nosotros te ayudamos a pedirlo.
- Podemos cambiar los precios con aviso previo; los cambios se aplican desde el inicio del siguiente ciclo de facturación.
- Nos autorizás, a nosotros y a nuestros procesadores de pago, a cobrar en el medio de pago registrado.
4. Uso aceptable
Te comprometés a no:
- Usar los Servicios con fines ilícitos.
- Aplicar ingeniería inversa, hacer scraping o intentar extraer el código fuente o los datos de los Servicios.
- Subir código malicioso, datos falsos o contenido que infrinja derechos de terceros.
- Usar los Servicios para tomar decisiones diagnósticas o de tratamiento sin la supervisión de un profesional de la salud.
- Interferir con la seguridad o el funcionamiento de los Servicios.
5. Resultados de la IA
Los Servicios generan información con modelos de IA. Algunas funciones buscan en una biblioteca de referencia (literatura publicada y, en el caso de las clínicas, documentos que sube la clínica); que se cite una fuente no hace que un resultado sea correcto. Los resultados de la IA pueden ser incompletos, desactualizados o incorrectos. Sos responsable de evaluarlos antes de basarte en ellos, y los profesionales de la salud siguen siendo los únicos responsables de las decisiones clínicas.
6. Uso clínico y seguridad
Bariatric AI es una aplicación de seguimiento. No está aprobada ni autorizada como dispositivo médico por la FDA, la ANMAT ni otro organismo, no reemplaza el consejo, el diagnóstico ni el tratamiento de un profesional y no es un servicio de emergencias. No hace diagnósticos ni toma decisiones de tratamiento: las decisiones clínicas las toma el médico tratante. En caso de emergencia, llamá al número de emergencias de tu país o andá a la guardia más cercana.
Avisos de síntomas. Algunas funciones (el chequeo de síntomas y el registro de dosis de la medicación GLP-1) te hacen preguntas cerradas sobre síntomas y, según tus respuestas, te muestran un aviso fijo que sugiere cuándo consultar a tu médico o buscar atención de urgencia. Si en un mensaje a tu equipo médico escribís palabras que pueden indicar una urgencia, la app también te muestra un aviso fijo. Esos avisos son automáticos y orientativos, no son un diagnóstico ni una indicación de tratamiento o de dosis, pueden no detectar un problema y no reemplazan la evaluación de tu médico. La decisión de consultar es tuya. Si te sentís mal, no esperes un aviso de la app ni la respuesta de un mensaje.
7. Propiedad intelectual
Los derechos sobre los Servicios, incluidos el software, los modelos, el contenido y las marcas, son y siguen siendo de Bariatric AI y de sus licenciantes. Mientras cumplas estos Términos, te damos una licencia limitada, no exclusiva, intransferible y revocable para usar los Servicios con el fin para el que fueron creados.
8. Tu contenido
Conservás la titularidad del contenido que enviás ("Contenido del Usuario"). Le das a Bariatric AI una licencia mundial y gratuita para alojar, procesar y mostrar el Contenido del Usuario en la medida necesaria para prestarte los Servicios. No usamos tu contenido para entrenar modelos de IA ni para estadísticas. Cómo tratamos tus datos personales está en nuestra Política de Privacidad.
9. Servicios de terceros
Los Servicios pueden tener enlaces a servicios de terceros o integrarse con ellos. No somos responsables por los servicios de terceros, y su uso se rige por sus propios términos y políticas.
El consultorio médico del fundador. Bariatric AI fue fundada por el Dr. Franco Corvatta, cirujano bariátrico que también atiende pacientes en su consultorio particular. El consultorio es un servicio independiente de Bariatric AI, con su propia historia clínica y sus propios términos. Bariatric AI no comparte los datos de tu cuenta con el consultorio, y la app no recomienda a ningún profesional de la salud en particular.
10. Terminación
Podés dejar de usar los Servicios y borrar tu cuenta en cualquier momento. Podemos suspender o dar de baja tu acceso si incumplís estos Términos o para proteger la integridad de los Servicios. Las disposiciones que por su naturaleza deban seguir vigentes después de la terminación siguen vigentes (por ejemplo, propiedad intelectual, exclusiones de garantía y limitaciones de responsabilidad).
11. Exclusión de garantías
LOS SERVICIOS SE PRESTAN "TAL COMO ESTÁN" Y "SEGÚN DISPONIBILIDAD". EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, RECHAZAMOS TODA GARANTÍA, EXPRESA O IMPLÍCITA, INCLUIDAS LAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO Y NO INFRACCIÓN.
12. Limitación de responsabilidad
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, BARIATRIC AI NO ES RESPONSABLE POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES O PUNITIVOS, NI POR LUCRO CESANTE O PÉRDIDA DE INGRESOS. NUESTRA RESPONSABILIDAD TOTAL POR CUALQUIER RECLAMO RELACIONADO CON LOS SERVICIOS NO SUPERA EL MAYOR DE (A) LO QUE NOS PAGASTE EN LOS 12 MESES ANTERIORES AL HECHO QUE DIO ORIGEN AL RECLAMO, O (B) USD 100.
13. Indemnidad
Te comprometés a mantener indemnes a Bariatric AI y a sus afiliadas frente a cualquier reclamo que surja de tu incumplimiento de estos Términos, de tu Contenido del Usuario o de un uso de los Servicios no autorizado por estos Términos.
Si sos consumidor: las secciones 11, 12 y 13 se aplican solo en la medida en que lo permita la ley de defensa del consumidor que te corresponda. En Argentina, no limitan los derechos que te da la Ley 24.240 ni la responsabilidad que esa ley pone a nuestro cargo.
14. Ley aplicable y resolución de conflictos
Estos Términos se rigen por las leyes de la República Argentina, sin tener en cuenta sus normas sobre conflicto de leyes.
Antes de iniciar una demanda, las partes van a intentar de buena fe resolver cualquier conflicto durante 30 días, escribiendo a legal@bariatricai.io y, si no lo logran, van a pasar por la mediación prejudicial obligatoria. Si no llegan a un acuerdo, las partes se someten a los tribunales ordinarios de la Ciudad de Buenos Aires, Argentina. Si usás los Servicios como consumidor, nada de esta sección limita tu derecho a reclamar ante los tribunales de tu propio domicilio ni ante la autoridad de defensa del consumidor.
15. Cambios a estos Términos
Podemos actualizar estos Términos. Si un cambio es importante, te avisamos por email o en los Servicios con al menos 30 días de anticipación. Si seguís usando los Servicios después de que el cambio entre en vigencia, rige la versión nueva. Si no estás de acuerdo, podés dejar de usar los Servicios y borrar tu cuenta.

17. Idioma
Estos Términos están en español y en inglés, y las dos versiones son oficiales. Si difieren, prevalece la más favorable para vos.
Terms of Service
These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, API and related services (collectively, the "Services") of Bariatric AI ("Bariatric AI," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms.
Important. The Services do not provide medical advice and are not a substitute for the judgment of a healthcare professional. See our Medical Disclaimer and section 6.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Services. By using the Services, you represent that you meet these requirements.
2. Accounts
2.1 Account creation
You agree to provide accurate information and to keep it up to date. You are responsible for the activity under your account and for safeguarding your credentials.
2.2 Clinic accounts (B2B)
Where a clinic or healthcare organization ("Clinic Customer") gives you access to the Services, the Clinic Customer is responsible for your use of the Services, and the Bariatric AI for Clinics B2B Terms and Conditions and the Data Processing Agreement that the Clinic Customer accepts when subscribing also apply. Bariatric AI does not currently sign HIPAA Business Associate Agreements (BAAs); see our HIPAA page.
3. Subscription Plans & Payment
- Bariatric AI for Clinics plans, prices and conditions are described at bariatricai.io/clinicas and governed by the Bariatric AI for Clinics B2B Terms and Conditions, which the clinic accepts when subscribing.
- B2C plans: a 7-day trial with limited use of the AI features (no credit card required), after which the account keeps only a small free allowance; Pro ($7.99/mo, or $86.29/yr billed annually) and Max ($11.99/mo, or $129.49/yr billed annually), billed monthly or annually unless otherwise stated. Pro and Max include a monthly allowance of AI messages and food-photo analyses, as shown in the app and on our pricing page.
- Fees are non-refundable except where required by law.
- Right of withdrawal (consumers in Argentina): if you purchased as a consumer online or in the app, you may withdraw from the purchase within 10 calendar days of making it, at no cost and without giving a reason, by writing to legal@bariatricai.io (article 34 of Law 24,240). If you purchased through the App Store or Google Play, the refund is processed by that store; we will help you request it.
- We may change prices on notice; changes apply at the start of the next billing cycle.
- You authorize us and our payment processors to charge the payment method on file.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose.
- Reverse-engineer, scrape, or attempt to extract the source code or data of the Services.
- Upload malicious code, false data, or content infringing third-party rights.
- Use the Services to make diagnostic or treatment decisions without the oversight of a healthcare professional.
- Interfere with the security or operation of the Services.
5. AI Outputs
The Services generate information using AI models. Some features search a reference library (published literature and, for clinics, documents the clinic uploads); citing a source does not make an output correct. AI outputs may be incomplete, outdated, or incorrect. You are responsible for evaluating outputs before relying on them, and healthcare professionals remain solely responsible for clinical decisions.
6. Clinical Use & Safety
Bariatric AI is a follow-up application. It is not cleared, approved or authorized as a medical device by the FDA, ANMAT or any other authority, it does not replace professional advice, diagnosis or treatment, and it is not an emergency service. It does not make diagnoses or treatment decisions: clinical decisions are made by the treating physician. In an emergency, call your local emergency number (911 in the United States) or go to the nearest emergency department.
Symptom notices. Some features (the symptom check-in and the GLP-1 medication dose log) ask you closed questions about symptoms and, based on your answers, show a fixed notice suggesting when to contact your doctor or seek urgent care. If a message you write to your care team contains words that may signal an emergency, the app also shows you a fixed notice. These notices are automatic and for guidance only, are not a diagnosis or a treatment or dosing instruction, may fail to detect a problem, and do not replace your doctor's assessment. The decision to seek care is yours. If you feel unwell, do not wait for a notice from the app or for a reply to a message.
7. Intellectual Property
All rights in the Services, including the software, models, content and trademarks, are and remain the property of Bariatric AI and its licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose.
8. Your Content
You retain ownership of the content you submit ("User Content"). You grant Bariatric AI a worldwide, royalty-free license to host, process and display User Content as necessary to provide the Services to you. We do not use your content to train AI models or for statistics. How we handle your personal data is described in our Privacy Policy.
9. Third-Party Services
The Services may link to or integrate with third-party services. We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
The founder's medical practice. Bariatric AI was founded by Dr. Franco Corvatta, a bariatric surgeon who also sees patients in his private practice. The practice is a service independent of Bariatric AI, with its own medical records and terms. Bariatric AI does not share your account data with the practice, and the app does not recommend any particular healthcare professional.
10. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the integrity of the Services. Provisions that by their nature should survive termination will survive (for example, intellectual property, disclaimers and limitations of liability).
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARIATRIC AI IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES DOES NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.
13. Indemnification
You agree to indemnify and hold harmless Bariatric AI and its affiliates from any claim arising out of your violation of these Terms, your User Content, or your use of the Services in a manner not authorized by these Terms.
If you are a consumer: sections 11, 12 and 13 apply only to the extent permitted by the consumer-protection law that applies to you. In Argentina, they do not limit the rights that Law 24,240 gives you or the liability that law places on us.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Argentine Republic, without regard to conflict-of-law rules.
Before filing suit, the parties will try in good faith to resolve any dispute for 30 days by writing to legal@bariatricai.io and, failing that, will go through the mandatory pre-trial mediation. If no agreement is reached, the parties submit to the ordinary courts of the City of Buenos Aires, Argentina. If you use the Services as a consumer, nothing in this section limits your right to bring a claim before the courts of your own domicile or before the consumer-protection authority.
15. Changes to These Terms
We may update these Terms. If a change is important, we will notify you by email or in the Services at least 30 days in advance. If you keep using the Services after the change takes effect, the new version applies. If you disagree, you can stop using the Services and delete your account.
